GTC
Last updated: 01.01.2024
These General Terms and Conditions of livevibe as the seller and you as the customer apply to all orders placed in the livevibe online shop (www.livevibe.ch) as well as to those purchases for which livevibe declares these GTC to be applicable.

Scope of application
The GTC apply to all services provided by livevibe in the online shop (www.livevibe.ch) and become effective upon the conclusion of a contract. Deliveries, services and offers by livevibe are provided exclusively on the basis of these GTC, even if they are not expressly agreed upon again. By submitting an order to LIVEVIBE, you confirm that you have read these GTC and expressly agree to them.

Conclusion of a contract
All information regarding goods and prices within the ordering process is non-binding and without obligation. Orders are binding for customers. Consequently, orders can neither be amended nor cancelled. For orders, customers receive a non-binding confirmation from the seller. Prior to the notification of dispatch, through which the contract with the seller is concluded, LIVEVIBE may revoke its offer without further notice. By placing your order, you confirm that you are fully aware of the scope and content of your order. Any questions in this regard may therefore be clarified with us in advance.

Delivery
Goods are generally dispatched via post or courier. The delivery period within Switzerland is typically 3 to 7 working days, unless otherwise stated for the respective product. These details are provided without guarantee.
If the sender provides an incorrect address or an address at which the postal service cannot locate the person, the return shipping costs charged by the postal service must be borne by the customer. Once the goods have been handed over to the postal service, all liability on the part of LIVEVIBE ceases. Accordingly, LIVEVIBE does not bear the transport risk.

Should an item from the range exceptionally be unavailable, we shall inform you of this as promptly as possible by email. In principle, LIVEVIBE reserves the right to make partial deliveries where this appears conducive to the efficient processing of the overall delivery. In such cases, no additional shipping costs shall be charged for the subsequent delivery. Furthermore, LIVEVIBE reserves the right to require 100% prepayment for international deliveries.

Prices
All prices on www.livevibe.ch are inclusive of the statutory value added tax applicable in Switzerland (currently 8.1%) and exclusive of shipping costs. The actual shipping costs are displayed in the shopping basket prior to the completion of the order. LIVEVIBE expressly reserves the right to adjust the prices stated online at any time without prior notice and without further explanation. The prices applicable at the time of placing the order on the website shall apply.

Shipping costs
Are calculated on the basis of the current rates of the postal service at:
http://www.post.ch/
Plus all costs incurred in connection with packaging.

Payment terms
The following payment methods are available to you: PayPal, credit card, Apple Pay and Google Pay. We also reserve the right to offer prepayment by bank transfer.
For prepayment by bank transfer, the payment period is generally 7 days. If payment is not received within this period, LIVEVIBE reserves the right to cancel the order and make the goods available for sale again. Any transfer fees shall be borne by you.

Retention of title; set-off; right of retention
(1) In the case of consumers, we retain title to the purchased goods until full payment of the invoice amount. If you are an entrepreneur acting in the exercise of your commercial or independent professional activity, a legal entity under public law, or a special fund under public law, we retain title to the purchased goods until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
(2) You shall only be entitled to set off claims if your counterclaims have been established by a court of law or are undisputed or acknowledged by us. Furthermore, you shall only have a right of retention insofar as your counterclaim is based on the same contractual relationship.
(3) If the customer is in default with any payment obligations towards us, all existing claims shall become immediately due and payable.

Guarantee and warranty
The guarantee for goods corresponds to generally customary standards and amounts to 24 months, and is provided by the manufacturer. Defective goods must be reported within 3 days of delivery or after the occurrence of the defect at the company address sc
