In this privacy policy, LIVEVIBE (hereinafter also referred to as "livevibe", "we" or "us") explains how we process your personal data in connection with the provision of our websites https://livevibe.ch. This is not an exhaustive description; other privacy policies, general terms and conditions and similar documents may govern specific matters.
We use the term "data" here synonymously with "personal data".

- Collection and Processing of Data
We collect data when you visit our websites and use the functionalities or services available on them. The processing of your data is limited to data that is necessary for the operation of a functional website and the provision of the content available on it. Your data is processed on the basis of agreed purposes or a legal basis. The specific data we process about you depends on the occasion and purpose of the processing. We only collect data that is necessary for the execution and handling of our products and services, or that you provide to us voluntarily. To the extent that this is not prohibited, we also obtain data from publicly accessible sources (e.g. debt enforcement registers, land registers, commercial registers, media or the internet including social media) or receive data from authorities and other third parties (such as credit agencies, address brokers, associations, contractual partners, internet analysis services, etc.).
The categories of data that you have provided directly to us and the categories of data that we receive about you from third parties include, among others:

- Master data: Name; salutation/title, address; email address; telephone number; gender; date of birth; nationality; information about the employer or company on whose behalf you contact us; role and function; information about your relationship with us; details of interactions with you; declarations of consent (e.g. for the newsletter or online contact form); social media profiles; photos and videos; copies of identity documents; payment information, etc.;
- Communication data: Data transmitted via a contact form, by email, telephone, letter or other means of communication; name; contact details; type, manner, location and time of communication and generally also its content (i.e. the content of emails, letters, etc.); information about your enquiry when you use an online contact form; order number; returned items, etc.;
- Contract and service data: Information when using our online offerings and/or with a view to a possible conclusion of a contract; information about your contracts (e.g. type and date of conclusion), information about the products and the services provided or to be provided; information about feedback (e.g. complaints, feedback on satisfaction, etc.); information required for the execution and management of contracts (e.g. information in connection with invoicing, customer service, technical support and the enforcement of contractual claims), etc.;
- Registration data: Name; address; email address; telephone number; date of birth; credit card information; bank account details, etc.;
- Behavioural and preference data: Information about user behaviour on our websites; information about the use of our products and services; information about your response to electronic communications; information about your location, e.g. when you search for a shop at a desired location via websites using Google Maps; information from input fields (e.g. search function), etc.;
- Other data: We may also collect data from you in other situations. For example, data may arise in connection with official or court proceedings (e.g. files, evidence, etc.). In the context of events offered by us, we may collect data about who attends events and when, and we may take photographs, videos and audio recordings in which you can be identified.
Within the scope of our business relationship, it is necessary for you to provide us with data required for the establishment and fulfilment of the contractual relationship. In general, there is no legal obligation to provide us with such data. However, without this data, we may not be able to conclude or continue the contract with you or the entity/person you represent. In addition, certain information must be disclosed to enable data traffic on the websites, e.g. an IP address.
- Purposes of Processing
The data collected is primarily used for the conclusion and performance of contracts with you and business partners, in particular in connection with the products and services offered on our websites. We also process the data to fulfil our legal obligations, both domestically and internationally.

As part of our business development, we may sell businesses, parts of businesses or companies to others or acquire them from others or enter into partnerships, which may result in the exchange and processing of data on the basis of your consent.
- Legal disputes: We process your data to enforce legal claims and to defend ourselves in legal disputes and official proceedings.
- Legal compliance: We process your data to meet legal requirements (e.g. prevention and investigation of criminal offences and other misconduct; conducting internal investigations, data analysis for fraud prevention).
- Legal Basis for Processing
Where we ask for your consent for certain processing operations (e.g. for receiving newsletters), we process your data on the basis of that consent. You may withdraw your consent at any time with effect for the future by written notice (email is sufficient) to us. If you wish to withdraw your consent to online tracking, please refer to section 8. The withdrawal of your consent does not affect the lawfulness of the processing we carried out prior to your withdrawal, nor does it affect the processing of your data on the basis of other legal grounds.
Where we have not asked for your consent, we process your data on other legal grounds, such as a contractual obligation, a legal obligation, a vital interest of the data subject or another natural person, for the performance of a task in the public interest, or a legitimate interest, which includes compliance with applicable law and the marketing of our products and services, the interest in better understanding our markets and managing and developing our business, including its operations, safely and efficiently.
- Profiling and Automated Decision-Making
We may automatically evaluate certain of your personal characteristics for the above-mentioned purposes based on your data ("profiling"), where we wish to determine preference data, but also to identify misuse and security risks, to carry out statistical evaluations or for operational planning purposes. For the same purposes, we may also create profiles, i.e. we may combine behavioural and preference data, as well as master and contract data and technical data assigned to you, in order to better understand you as a person with your various interests and other characteristics. We may also use profiling to assess your creditworthiness. We do not use profiling that may have legal effects on you or significantly affects you in a similar manner without human review.
In certain situations, for reasons of efficiency and consistency of decision-making processes, it may be necessary for us to automate discretionary decisions concerning you with legal effects or potentially significant disadvantages ("automated individual decisions"). In such cases, we will inform you accordingly and take the measures required by applicable law.
- Disclosure of Data to Third Parties
To fulfil our contracts, to meet our legal obligations, to safeguard our legitimate interests and to fulfil the other purposes and legal grounds mentioned above, we may disclose your data to third parties, in particular to the following categories of recipients:
- Service providers: We work with service providers in Switzerland and abroad who process data about you on our behalf or under joint responsibility with us, or who receive data about you from us under their own responsibility (e.g. IT providers, banks, insurance companies, telecommunications companies, credit agencies, address verification providers, payment service providers, lawyers), or whom we commission to process data for one of the above-mentioned purposes on our behalf and only in accordance with our instructions.
- Contractual partners: Where the respective contract so requires, we pass on your data to other contractual partners, dealers, subcontractors, etc.
- Authorities: We may disclose personal data to offices, courts and other authorities in Switzerland or abroad if we are legally obliged or entitled to do so, or if this appears necessary to safeguard our interests. The authorities process data about you received from us under their own responsibility.
- Newsletter
If you subscribe to one of our offered newsletters, you can cancel the subscription at any time by using the unsubscribe option contained in the newsletter.
In connection with our newsletter and on the basis of your consent, we use the tools listed in section 12 to collect your data when you sign up for our newsletter or other updates, and to ensure that you only receive newsletters and updates that match your actual or perceived interests.
- Cookies
We use cookies on our websites that enable us to identify your browser or device, and that may enable certain third-party providers to do the same. Cookies are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our websites.
Some cookies are required for the functioning of our websites or for certain features. These cookies exist only temporarily ("session cookies") and are deleted after you have visited our websites. - Social Plug-ins
We use social plug-ins from YouTube and Instagram on some of our websites. You can recognise these in each case (usually by the corresponding icons). We have configured these elements so that they are disabled by default. If you activate them (by clicking on them), the providers of the respective social networks can register that and where you are on our websites and use this information for their own purposes. Your data is then processed under the responsibility of the respective provider in accordance with their privacy policy. We do not receive any information about you.
- Our Presence on Social Networks
We maintain various presences on social media platforms. We operate presences with the following providers: Facebook, LinkedIn, Instagram, Pinterest, TikTok, YouTube, Twitter/X and Snapchat.
We receive data from you and the platforms when you contact us via our online presence. At the same time, the platforms analyse your use of our online presences and link this data with further data about you known to the platforms. They also process this data for their own purposes under their own responsibility, in particular for marketing and market research purposes and to manage their platforms.
We would like to point out that you use our presences on social media platforms and their functions at your own responsibility. This applies in particular to the use of interactive functions (e.g. commenting, sharing, rating). For information about the collection and storage of your data as well as the nature, scope and purpose of their use by the operator of the respective social media platform, please refer to the privacy policies of the respective operator.

- YouTube
On this website, we use the services of YouTube. This enables us to play videos directly on the website and allows you to conveniently use the video function.
YouTube is part of Google; Google Ireland (based in Ireland) is the provider of the "YouTube" service and acts as our data processor. Google Ireland relies on Google LLC (based in the USA) as its data processor (both "Google").
Normally, your IP address is already sent to YouTube when you access a page with embedded videos and cookies are installed on your computer. However, we have embedded our YouTube videos using the enhanced privacy mode (in this case, YouTube still contacts Google's DoubleClick service, but according to Google's privacy policy, personal data is not evaluated). As a result, YouTube no longer stores information about visitors unless they watch the video. When you click on the video, your IP address is transmitted to YouTube and YouTube learns that you have watched the video. If you are logged in to YouTube, this information is also assigned to your user account (you can prevent this by logging out of YouTube before accessing the video).
We have no knowledge of, and no influence over, any subsequent collection and use of your data by YouTube. Further information can be found in YouTube's privacy policy.

We use functions of the live chat service Chatra on our websites, which is offered by Roger Wilco LCC based in the USA. We have concluded a data processing agreement with Roger Wilco LCC and fully implement the strict requirements of the GDPR when using Chatra. We use functions of the customer support service Gorgias on our websites, which is offered by Gorgias in the USA. We use functions of the e-commerce platform Shopify on our websites, through which the LIVEVIBE web shop operates. Shopify Inc. is based in Canada. - Matrixify
We use functions of the data processing service Matrixify on our websites, which enables the import and export of data as well as the analysis of data from Shopify. We use the functions of MF Group on our websites for purchase on account in Switzerland. MF Group AG is based in Switzerland. We use functions of Google on our websites. Google Ireland (based in Ireland) is the provider of the "Google Analytics" service and acts as our data processor. Google tracks visitor behaviour on our websites through performance cookies (duration, frequency of pages accessed, geographical origin of access, etc.) and creates reports on the use of our websites on this basis. We likely use functions of ByteDance Ltd. on our websites, the company behind the short-form video hosting service TikTok. - Transfer of Data Abroad
As explained in the sections above, we also disclose data to other entities. These are not only located in Switzerland. Your data may therefore be processed both in Europe and in the USA; Hong Kong, Ireland, India, Canada, Lithuania, Denmark, Germany, Estonia, Israel, the United Kingdom, Latvia and France; in exceptional cases, however, in any country in the world.
We only transfer data to countries without adequate legal data protection where this is necessary for the performance of a contract or for the assertion or defence of legal claims, or where such transfer is based on your express consent or is subject to guarantees that ensure the protection of your data, such as the standard contractual clauses approved by the European Commission (adapted to Switzerland where applicable).
- Data Retention Periods
We only process your data for as long as is necessary to fulfil the purposes for which we collected it, including compliance with legal retention obligations and, to the extent necessary for the assertion or defence of legal claims, until the end of the respective retention period or until the relevant claims have been settled. Upon expiry of the respective retention period, we will securely destroy your data in accordance with applicable laws and regulations.
- Data Security
We take appropriate security measures to maintain the confidentiality, integrity and availability of your data, to protect it against unauthorised or unlawful processing and to counteract the risks of loss, unintentional alteration, unwanted disclosure or unauthorised access. Nevertheless, we and your data may fall victim to cyberattacks, cybercrime, brute force methods, hacker attacks and other fraudulent and malicious activities, including but not limited to viruses, forgery, malfunctions and interruptions, which is beyond our control and responsibility. We have also established procedures for dealing with suspected data breaches and will notify you and all competent supervisory authorities of a breach if we are legally obliged to do so.
- Your Rights
In connection with the processing of your data by us, you have various rights depending on the applicable data protection law: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, right to withdraw consent, right to lodge complaints and right to object.
Please note that we reserve the right to invoke legal restrictions where necessary, for example if we are obliged to retain or process certain data, have an overriding interest (to the extent we may rely on such interests) or require the data to assert claims.
